Terms

These terms and conditions (“Terms”) are concluded between the Paul Janssen Futurelab Leiden, a division of the Leiden University Medical Center (LUMC), Albinusdreef 8, 2333 ZA Leiden, the Netherlands and the Participant. The course description that is posted on the Paul Janssen Futurelab Leiden website (www.pauljanssenfuturelab.eu) at the time when the Participant  registers via this website for a Course shall determine the contractual relationship between the Paul Janssen Futurelab Leiden and the Participant, as set forth in these Terms.

These Terms apply to the Courses offered by the Paul Janssen Futurelab Leiden. The specific goal, audience and content of each Course is identified in the online webshop of the Paul Janssen Futurelab Leiden. Following a Course requires prior registration and the payment of a course fee. Payment of the course fee by the Participant (or by his/her employer) constitutes acceptance of these Terms.

The Participant is advised that the Dutch Civil Code (“Burgerlijk Wetboek”), entitles him/her to cancel the subscription to a Course at no cost if such cancellation is received by the Paul Janssen Futurelab Leiden within fourteen  (14)  days after registration via the website.

Other Definitions in these Terms

  • Course: a course produced and managed by the Paul Janssen Futurelab Leiden. Every Course contains a teaching phase using an Internet-based digital learning platform, concluded by an online exam that results in the grant of a course certificate. A Course can also contain a second (optional) phase which is taught on-campus at premises which will be announced at the website PaulJanssenFuturelab.eu.
  • Participant: a physical person who has duly registered him / herself to participate to a Course via the website of the Paul Janssen Futurelab Leiden and whose course fee has been paid.

Minimum course requirements

There are minimum course requirements for each Course. They constitute guidelines issued by the Paul Janssen Futurelab Leiden, allowing a Participant to evaluate his/her suitability to follow a Course. The minimum requirements for each Course are posted on the Paul Janssen Futurelab Leiden website.

By registering for a Course, the Participant acknowledges that he/she has read these minimum course requirements and that he/she has the required qualifications and necessary availability to follow the Course within the indicated time period.

The Paul Janssen Futurelab Leiden retains the right to refuse a Participant to a Course should the Participant, in the opinion of the Paul Janssen Futurelab Leiden’s Director, not meet the minimum course requirements. In such case, the course fee will be reimbursed. A candidate can always re-apply at a later stage and become a Participant. Rejection of a candidate for one specific Course does not prevent a candidate to apply for other Courses offered by the Paul Janssen Futurelab Leiden.

Termination / Cancellation

During a Course

If a Participant does not pass the online exam of a Course, he/she will not be admitted to the on-campus part of that Course (if applicable) and the on-campus part of the course fee will be reimbursed.

If a Participant does not respect some or all of the Terms during or after the Course, the Paul Janssen Futurelab Leiden may terminate his/her participation to that Course and refuse all future access to the learning platform by blocking his account.

Before a Course

Cancellation by the Paul Janssen Futurelab Leiden

The Paul Janssen Futurelab Leiden reserves the right to cancel a Course because of insufficient registrations or because of an unexpected event of force majeure (“overmacht”) that occurred outside of its control and that makes the Course impossible to run. Such cancellation will be notified by the Paul Janssen Futurelab Leiden to the Participant by email not later than one (1) week prior to the start of the Course.

Cancellation by a Participant

All cancellations by a Participant must be received by the Paul Janssen Futurelab Leiden in writing or by email prior to the start of a Course.

If a registration is cancelled by a Participant not later than six (6) weeks prior to the start of the Course, Paul Janssen Futurelab Leiden will refund 100% of the course fee.

If a registration is cancelled by a Participant between the sixth and the fourth week prior to the start of the Course, the Paul Janssen Futurelab Leiden will refund 75% of the course fee.

If a registration is cancelled by a Participant between the fourth and the second week prior to the start of the Course, the Paul Janssen Futurelab Leiden will refund 50% of the course fee.

The Paul Janssen Futurelab Leiden will at any time duly consider a Participant’s request to move his registration to a future edition of a Course, at no extra charge.

Course fee

The fee for each Course is posted on the Paul Janssen Futurelab Leiden website. The course fees but do not include costs associated with travel, accommodations and meals for attending the (optional) on-campus part of the Course, which shall be borne by the Participant.

The Paul Janssen Futurelab Leiden reserves the right to modify the Course program and/or material and/or replace the instructors in the event of illness and/or non-availability. Such modifications shall not give right to a cancellation, refund or other change of the course fee.

Attendance to a Course

Each Participant can freely choose his/her own time slots to follow the five (5) weeks of the Course taught via the online platform. The start date of each of the five weeks of a Course is announced on the website, as well as the period during which the online exam must be taken. There is no time limit for a Participant to consult the Course afterward via the learning platform, but the exam must be taken during the announced time window.

The Participant is encouraged to attend the joint online sessions that are organized via videocall by the Course tutor during the five weeks Course at specific dates.

For the on-campus part of the Course, physical attendance of the Participant is required. In case the Participant is unable to attend any session of an on-campus course, he/she will notify the Director of the Paul Janssen Futurelab Leiden in advance, including the reason for his/her absence.

Privacy policy

The Paul Janssen Futurelab Leiden privacy policy complies with the Dutch Personal Data Protection Act (“Wet Bescherming Persoonsgegevens”).

The personal information (hereinafter referred to as “Information”) that is collected from the Participant will only be processed for the effective and efficient administration and organization of the Courses and for interaction with the other Course Participants. The Information includes full name and title of the Participant, his/her e-mail address, mailing address, telephone number, information regarding the organization and/or company at which the Participant is employed when the Course is taken, and information regarding the Participant’s education and past work experience.

By using and registering for the Course via the Paul Janssen Futurelab Leiden online learning platform, the Participant consents to the use of his or her Information, more in particular to the sharing of his/her name, professional function and mail address with the other course Participants via the Dashboard of the Course. The content of the Dashboard will be available only to the staff of the Paul Janssen Futurelab Leiden, the tutor and to the other Participants of that Course for which the Participant registered. The participant’s chats and input on the assignments will be deleted six months after the start of the course. Tutor’s support ends seven weeks after the start of the course.

The Paul Janssen Futurelab Leiden does not sell, rent, or make otherwise available to third parties any Information for marketing or other purposes. The other Course Participants, the tutor and the staff who organize and monitor the Course are permitted to gain access to the Information.

Feedback received from a Participant on a Course may be used in advertising materials of the Paul Janssen Futurelab Leiden for future Courses.

Transfer or substitution

The registration and attendance for a Course is strictly personal. Each participant is admitted to the Course on the basis of his/her personal qualifications. An exam certificate is issued only to Participants on a name basis.

Neither a Participant nor his/her employer can transfer or otherwise change a Participant’s personal right to attend the Course, or to delegate the exam to someone else.

The Paul Janssen Futurelab Leiden will duly consider any request for change / switch of a  Participant by another individual, if such request is made prior to the start of a Course and the individual complies with the minimum course requirements.

Confidentiality of course materials

The Paul Janssen Futurelab Leiden uses in its Courses some case studies based on real-life events and R&D projects. At the end of such cases, the results are revealed that occurred in real-life, most of which are not publicly known. A Participant will therefore not reveal the content and the outcomes of the cases to others outside the Course, to ensure that the learning experience for future course participants is preserved.

For the same reasons, some course materials cannot be downloaded nor printed, but can be viewed only on the Paul Janssen Futurelab Leiden learning platform. The Participant understands and acknowledges the importance of keeping the teaching materials confidential, and agrees not to reveal their content to anyone outside the Course. Any violation of this obligation can result in the immediate blocking of the Participant’s account, precluding all access to the Course and to the materials, and without prejudice to the right for seeking injunctions, damages or other remedies allowed under applicable law.

These confidentiality obligations continue to apply after completion of a Course and at least ten (10) years thereafter, or as long as the Paul Janssen Futurelab Leiden Courses remain available, whichever period is longer.

Access after a Course

After completion of a Course, a Participant retains access to the learning platform and to the learning materials related to the Course(s) in which he/she participated for as long as the courses remain available, provided that the confidentiality and intellectual property undertakings in these Terms are continuously complied with.

Intellectual Property Rights

The Paul Janssen Futurelab Leiden Courses contain texts, animations, interviews, articles, graphics, teaching case studies and other materials that are protected by copyright and whose ownership lies either with the Paul Janssen Futurelab Leiden or with the authors and publishers of the works as made available via the Course.

The Participant will respect the intellectual property rights of the Paul Janssen Futurelab Leiden and of these third parties. The Participant has only a personal, non-transferable license to read and consult the Course, and to make only personal use of the exercises and tools provided via the Courses for educational purposes. No course materials or parts thereof may be reproduced, made available to the public and/or transmitted to third parties in any form or manner, printed, photocopied, microfilmed, electronically copied, or otherwise, without prior written permission from Paul Janssen Futurelab Leiden’s Director.

Neither these Terms nor the Course constitute a transfer, license or other right of use to any material in the Course protected by intellectual property rights of Paul Janssen Futurelab Leiden or of third parties. All of Paul Janssen Futurelab Leiden’s rights (including but not limited to copyrights, trademark rights, titles, and any other commercial rights) remain the property of Paul Janssen Futurelab Leiden.

Any violation of these obligations can result in the immediate blocking of the Participant’s account, precluding all access to the Course and to the materials, and without prejudice to the right for seeking injunctions, damages or other remedies allowed under applicable law.

Liability

Paul Janssen Futurelab Leiden does not guarantee the completeness and/or correctness of its Course and nothing in the Course can be understood, construed, forwarded to third parties or relied upon as legal advice. The Paul Janssen Futurelab Leiden is not responsible for damage arising from any decision, action or information based upon the course materials and/or on information otherwise provided within the context of the Course.

Paul Janssen Futurelab Leiden is not liable for any damage incurred by a Participant due to cancellation of any or all parts of a Course.

Paul Janssen Futurelab Leiden is not liable for comments or information given by other Course Participants on the learning platform, and will not exercise control over such communication to allow educational freedom of expression.

Although the Participant is encouraged to exchange and communicate as much as possible with his her fellow course participants, he/she will always communicate on the platform with the required professional reservation and courtesy, not unnecessarily use or involve brands or names of third parties in his/her communication on the platform, and avoid defamation, libel or other language that could tarnish the reputation of other Participants, the brands of the companies and individuals featuring in the Course, as well as their products and services.

Applicable law and dispute resolution

The relationship between the Paul Janssen Futurelab Leiden and the Participant is governed exclusively by the law of the Netherlands, with the exclusion of its principles of private international law that would cause the application of a foreign law.

All disputes in connection with the interpretation or enforcement of these Terms falls within the exclusive jurisdiction of the courts in The Hague, the Netherlands.
